Terms of Service — Elyon Insurance Group (ACA Marketplace)

1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of the website, online eligibility-check form, and related services offered by Alpha Omega Center dba Elyon Insurance Group ("Elyon," "we," "us," "our"). By submitting our eligibility-check form, requesting a call or appointment, or otherwise using our services, you agree to these Terms. If you do not agree, please do not use our website or services.

2. Description of Services

Elyon is a licensed insurance agency, led by Dr. Elon Miree, D.Min (NPN 7646801), that helps individuals check their potential eligibility for Affordable Care Act (ACA) Health Insurance Marketplace coverage and premium tax credit subsidies, and — if they choose to proceed — apply for and enroll in a plan through a licensed agent using a CMS-approved Enhanced Direct Enrollment (EDE) platform.

Important: This is a solicitation for insurance. Elyon Insurance Group is a licensed insurance agency and is not affiliated with or endorsed by the U.S. government, the federal Health Insurance Marketplace, or Healthcare.gov. We do not offer every plan available in your area. You may always apply directly, free of charge, at Healthcare.gov or by calling the Marketplace Call Center at 1-800-318-2596.

Final eligibility determinations, subsidy amounts, and enrollment approvals are made by the federal Health Insurance Marketplace and the applicable insurance carrier — not by Elyon. We assist with the application process; we do not guarantee eligibility, subsidy amount, or enrollment outcome.

3. Eligibility Check, Consumer Consent, and Enrollment Process

Submitting our online eligibility-check form provides a preliminary, non-binding estimate only. Before we search for plans, provide a quote, or submit any application on your behalf, federal Marketplace rules require you to complete a Consumer Consent to Assist authorizing a licensed agent to act on your behalf. Before final submission of your application, you must also complete an Eligibility Application Review/Attestation confirming that the information in your application is accurate to the best of your knowledge.

Enrollment in an ACA Marketplace plan is generally limited to the annual Open Enrollment Period or a Special Enrollment Period for which you qualify due to a life event (such as marriage, birth of a child, loss of other coverage, or a household income change). We will let you know if you appear eligible for a Special Enrollment Period, but final determination is made by the Marketplace.

4. Consent to Be Contacted

By submitting our eligibility-check form or otherwise providing your phone number or email address, you consent to be contacted by Elyon Insurance Group and its licensed agents by phone call, text message (SMS), and email — including by autodialer or prerecorded message — regarding ACA Marketplace health coverage. Message and data rates may apply. Consent is not a condition of purchasing insurance. You may revoke consent at any time by replying STOP to a text message or contacting us using the information in Section 17.

Note: This contact consent is separate from the Consumer Consent to Assist described in Section 3. This section governs whether — and how — we may contact you; the Consumer Consent to Assist governs what we are authorized to do on your behalf once we speak with you. This consent checkbox is a required field on our web form and cannot be pre-checked.

5. No Cost to Request an Eligibility Check

There is no cost to submit our eligibility-check form or to speak with a licensed agent about your potential Marketplace options. Any premium, deductible, copay, or other cost-sharing amount for a specific plan is set by that plan's carrier and by the federal Health Insurance Marketplace based on your household's actual income and eligibility, and is not guaranteed, fixed, or controlled by Elyon. Any subsidy or premium tax credit amount referenced during your consultation is an estimate only and is subject to final Marketplace determination.

(Editorial note: avoid advertising "$0/month" or similar fixed-price claims — the FTC has taken enforcement action against ACA lead-generation marketing using unqualified low-cost claims. Any cost figure shown should be clearly labeled as an example or estimate, not a guarantee.)

6. Enrollment Periods and Plan Changes

ACA Marketplace enrollment is subject to federal Open Enrollment and Special Enrollment Period rules. Outside of an active enrollment window, we cannot enroll you in a new plan or make certain plan changes on your behalf, regardless of when you contact us. We will inform you of your next available enrollment opportunity if you contact us outside a window.

7. Accuracy of Information

You agree to provide accurate and complete information when using our eligibility-check form and during your application, including household size, income, and any other information requested. Providing inaccurate information may affect your eligibility determination, subsidy amount, or result in a requirement to repay excess premium tax credits to the IRS. Elyon is not responsible for consequences resulting from inaccurate information you provide.

8. Third-Party Enrollment Platform

We use a CMS-approved, third-party Enhanced Direct Enrollment (EDE) platform to submit Marketplace applications. Your use of that platform through our assistance is also subject to that platform's own terms of service and privacy policy, which will be provided to you before you submit your application through it.

9. Website Use

You agree to use our website only for lawful purposes and not to submit false information, attempt to access other users' data, or interfere with the website's operation.

10. Disclaimers

THIS WEBSITE AND OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." WE MAKE NO WARRANTY, EXPRESS OR IMPLIED, REGARDING YOUR ELIGIBILITY FOR ANY PLAN OR SUBSIDY, THE AVAILABILITY OF ANY PLAN, OR THE OUTCOME OF ANY APPLICATION. WE DO NOT GUARANTEE THAT ANY PARTICULAR PLAN, PREMIUM, OR SUBSIDY AMOUNT WILL BE AVAILABLE TO YOU. FINAL DETERMINATIONS ARE MADE SOLELY BY THE FEDERAL HEALTH INSURANCE MARKETPLACE AND THE APPLICABLE INSURANCE CARRIER.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ELYON INSURANCE GROUP'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THIS WEBSITE OR OUR SERVICES SHALL NOT EXCEED $100. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF COVERAGE, DENIED CLAIMS, OR SUBSIDY REPAYMENT OBLIGATIONS ARISING FROM INFORMATION YOU PROVIDED.

(Editorial note: confirm this liability cap and its enforceability with counsel and your E&O carrier before publishing — subsidy repayment and enrollment-error exposure in ACA work can be material, and a flat $100 cap may not be appropriate or defensible for this product line.)

12. Indemnification

You agree to indemnify and hold harmless Elyon Insurance Group, its agents, and employees from any claim arising from inaccurate information you provided or your misuse of our website or services.

13. Intellectual Property

All content on this website, including text, graphics, and logos, is the property of Elyon Insurance Group or its licensors and may not be copied or reproduced without permission.

14. Changes to These Terms

We may update these Terms from time to time. The "Effective Date" at the top of this page reflects the most recent revision. Continued use of our website or services after a change constitutes acceptance of the updated Terms.

15. Termination

We may decline to provide services, or discontinue an eligibility check or application in progress, at our discretion, including if we believe information provided is inaccurate or fraudulent.

16. Governing Law

These Terms are governed by the laws of the State of Alabama, without regard to conflict-of-law principles. Any dispute shall be resolved in the state or federal courts located in Montgomery County, Alabama.
