1. Introduction

Alpha Omega Center dba Elyon Insurance Group ("Elyon," "we," "us," "our") is a licensed insurance agency headquartered in Montgomery, Alabama, led by Dr. Elon Miree, D.Min (NPN 7646801). We help individuals check their eligibility for Affordable Care Act (ACA) Health Insurance Marketplace coverage and subsidies, and — if they choose — apply for and enroll in a plan through a licensed agent using a CMS-approved Enhanced Direct Enrollment (EDE) platform.

This Privacy Policy describes how we collect, use, disclose, and safeguard the Personal Information of individuals who visit our website, submit our eligibility-check form, complete a Consumer Consent to Assist or Eligibility Application Attestation, or otherwise interact with us in connection with ACA Marketplace coverage.

We comply with applicable U.S. federal and state privacy laws and CMS Marketplace agent/broker requirements. California residents should review Section 4 for additional rights.

Note: Elyon Insurance Group is an independent, licensed insurance agency. We are not connected with or endorsed by the U.S. government, the federal Health Insurance Marketplace, or Healthcare.gov. We do not offer every plan available in your area.

2. What Personal Information May We Collect and Disclose About You?

From our online eligibility-check form:

  • Full name, phone number, and email address
  • ZIP code
  • Whether you are currently insured, household size, and income range (used only to estimate potential eligibility)

During your Consumer Consent to Assist and application process:

  • Social Security number and date of birth for household members applying for coverage, as required by the Marketplace application
  • Detailed household income and tax-filing information used to determine subsidy eligibility
  • Immigration or citizenship status information, only as required by the Marketplace application
  • Records of communications by phone, text (SMS), email, or in-person/virtual visit
  • Your signed Consumer Consent to Assist and Eligibility Application Review/Attestation

Automatically from website visits:

  • IP address, browser type, device type, and operating system
  • Pages visited, time spent, and referring URL
  • Interaction data collected via cookies or similar tracking technology

3. How Will We Use Your Personal Information?

We use your Personal Information solely to:

  • Check your potential eligibility for ACA Marketplace coverage and subsidies
  • Obtain your Consumer Consent to Assist before searching, quoting, or applying on your behalf, as required by CMS
  • Complete and submit your Marketplace application through our CMS-approved Enhanced Direct Enrollment (EDE) platform
  • Obtain your Attestation confirming the accuracy of your application before submission
  • Contact you by phone, text (SMS), or email regarding your eligibility check, application status, and enrollment
  • Comply with CMS Marketplace recordkeeping and audit requirements
  • Improve our website, outreach, and enrollment process
  • Detect and prevent fraudulent applications
SMS / Call / Autodialer Consent: By submitting our eligibility-check form, you consent to be contacted by Elyon Insurance Group and its licensed agents by phone call, text message (SMS), and email, including by autodialer or prerecorded message, about ACA Marketplace health coverage. Message and data rates may apply. Reply STOP to opt out of texts. Consent is not a condition of purchase. This consent checkbox is required to submit the form and cannot be pre-checked.

4. State Consumer Privacy Notice

This section applies to residents of California (CCPA/CPRA), Virginia (VCDPA), Colorado (CPA), Connecticut (CTDPA), and other applicable U.S. states. Because ACA Marketplace enrollment is federally regulated, some Personal Information we collect is governed primarily by CMS Marketplace rules rather than state consumer privacy law. To the extent state law applies, the rights described in Section 12 are available to you.

8. Why We Collect Personal Information

  • To obtain the required Consumer Consent to Assist and Attestation before quoting, applying, or submitting on your behalf
  • To complete and submit your Marketplace application
  • To communicate with you about your eligibility check, application status, and enrollment
  • To comply with CMS Marketplace recordkeeping and audit obligations
  • To detect and prevent fraudulent applications
  • To improve our outreach programs, website, and enrollment process

9. Sharing or Selling Your Personal Information

We do not sell your Personal Information. We do not share your Personal Information with other agents, agencies, or lead-generation companies, and we do not use it for cross-context behavioral advertising. We share Personal Information only as required to check your eligibility or complete an application:

  • With the federal Health Insurance Marketplace, via our CMS-approved EDE platform, as required to submit and process your application
  • With technology service providers (CRM, scheduling, communications) under confidentiality obligations
  • With government agencies, regulators, or law enforcement as required by applicable law or regulatory audit

10. Sensitive Personal Data

We collect Social Security numbers, dates of birth, household income, and — where required by the Marketplace application — immigration or citizenship status. This Sensitive Personal Information is used solely to determine your eligibility, complete your Marketplace application, and calculate any subsidy for which you may qualify. Access is strictly limited to your licensed agent and authorized Elyon staff directly involved in your application. We never use Sensitive Personal Information for marketing or any purpose unrelated to your Marketplace application.

11. How Long We Retain Your Personal Information

  • Your Consumer Consent to Assist and Attestation are retained for a minimum of 10 years, per CMS Marketplace recordkeeping requirements
  • Enrollment application records are retained for a minimum of 10 years
  • Pre-application inquiries that did not result in a completed application are retained in our CRM for a reasonable period, then deleted or de-identified
  • Website usage data and communications records are retained as long as reasonably necessary for program operations and legal obligations
Note: CMS Marketplace recordkeeping requirements take precedence over any deletion request where retention is required by CMS rules or audit obligations.

12. Your Rights

Depending on your state of residence, you may have the right to:

  • Know what Personal Information we have collected, used, and disclosed about you
  • Access a portable copy of your Personal Information
  • Correct inaccurate Personal Information we hold about you
  • Delete your Personal Information, subject to CMS recordkeeping requirements and other legal exceptions
  • Opt Out of any sale or sharing of Personal Information (we do not sell or share it for advertising)
  • Limit Use of Sensitive Personal Information beyond what is necessary for your application
  • Opt Out of SMS/Call by replying STOP to any text message, or by contacting us directly
  • Non-Discrimination — you will not be denied eligibility-check assistance for exercising your privacy rights

13. How to Exercise Your Rights

To submit a privacy rights request — including to access, correct, delete, or opt out of communications — contact us using the information in Section 16. We may need to verify your identity before processing your request. You may designate an authorized agent to submit requests on your behalf, subject to identity verification.

14. Timing

We will acknowledge receipt of your privacy rights request within 10 business days and provide a substantive response within 45 calendar days. If we require additional time due to the complexity of the request, we will notify you within the initial window and may extend our response by an additional 45 days with written notice.

15. Appeals

If we decline to act on your privacy rights request, we will provide a written explanation, including any applicable CMS obligations that restrict our ability to comply. You may appeal by contacting us via the information in Section 16. We will respond within 45 calendar days. Eligibility and application disputes may also be directed to the Marketplace Call Center or CMS. State residents may additionally submit a complaint to their state Attorney General's office.
